Terms and Conditions

Welcome to Panorama Home Photography! These Terms and Conditions govern your use of our real estate photography, videography, and related media services as well as your access to our website www.panoramahomephotography.com. By booking a service with us, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.

If you do not agree to these terms, you may not use our services.

1. Services Provided

Panorama Home Photography specializes in professional real estate media, including:

  • HDR Photography
  • Aerial Drone Photography & Videography (FAA Part 107 compliant)
  • Walk-through Video Tours
  • 2D Floor Plans
  • 3D Virtual Tours (e.g., Matterport, Zillow 3D Home, etc.)
  • Twilight & Virtual Twilight Photography
  • Virtual Staging & Image Enhancement

These services are designed exclusively for real estate professionals, including realtors, brokers, property managers, builders, and homeowners, to enhance property listings.

2. Booking & Payment Policy

2.1 Scheduling

  • All bookings must be scheduled at least 24 hours in advance through our website, phone, or email.
  • The availability of services is not guaranteed and is subject to our photographers’ schedules.
  • Bookings are confirmed only after payment has been received.

2.2 Payment Terms

  • Full payment is required at the time of booking to secure an appointment.
  • Payments can be made via credit/debit card, online payment services, or any other methods listed on our website.

2.3 Cancellation & Rescheduling Policy

  • More than 2 hours before the appointment → Full refund.
  • Less than 2 hours before the appointment → Refund minus a $50 cancellation fee.
  • No-shows or cancellations after the scheduled time → Refund minus a $50 cancellation fee.
  • If Panorama Home Photography must cancel due to unforeseen circumstances (e.g., emergencies, severe weather, or equipment failure), we will attempt to reschedule at the earliest convenience or issue a full refund.

3. Client Responsibilities & Property Preparation

To ensure high-quality results, the property must be fully prepared before the scheduled appointment.

3.1 Required Preparations

Before the photographer arrives, the client should ensure that:
✅ All interior and exterior lights are turned on
✅ All ceiling fans are turned off
✅ All blinds and curtains are fully open
✅ All vehicles are removed from driveways and in front of the home
✅ No people or pets are present in the shoot area

3.2 Photographer’s Role & Limitations

  • The photographer is not responsible for cleaning, decluttering, or staging the property.
  • The photographer will not move furniture, objects, or personal items.
  • If the property is not ready at the scheduled time, the photographer will wait up to 10 minutes. After this time, the appointment will be canceled and subject to a $50 cancellation fee.

4. Delivery & Turnaround Times

4.1 Standard Delivery Times

  • HDR Photos: Within 24 hours
  • Videos: Within 72 hours
  • Floor Plans & 3D Tours: Delivered as soon as available from third-party providers

4.2 File Formats & Delivery Method

  • All final images and videos will be delivered digitally via an online download link (e.g., Dropbox, HDPhotoHub, etc.).
  • No physical copies (e.g., USBs, printed images) will be provided unless specifically arranged in advance.

5. Copyright & Licensing of Media

5.1 Ownership of Media

  • Panorama Home Photography retains full copyright ownership of all photos, videos, and other media.
  • Clients are granted a limited-use license to use the media only for the marketing and sale/rental of the property for which it was originally commissioned.

5.2 Restrictions on Use

🚫 You may NOT:

  • Sell, transfer, or sublicense the media to third parties without written consent.
  • Use the media for personal, commercial, or promotional purposes outside of the original listing.
  • Modify or edit the media without permission.

5.3 License Termination

If a full refund is issued for any reason, the client’s license to use the images is immediately revoked, and the images must not be used or distributed.

6. Weather & Unforeseen Circumstances Policy

6.1 Bad Weather Conditions

  • If weather conditions prevent a shoot (e.g., rain, snow, high winds), the client may reschedule up to 1 hour before the appointment at no charge.
  • If the client cancels less than 1 hour before the shoot due to weather, the $50 cancellation fee may apply, at the photographer’s discretion.

6.2 Drone Photography & Safety

  • Drone services may be canceled or postponed if the operator determines it is unsafe to fly.
  • If drone services cannot be completed, the client may choose to reschedule or receive a refund for the drone portion of the service only.
  • If the drone service was part of a package, the refund will reflect only the prorated value of that service.

7. Third-Party Services & Editing

  • Editing, hosting, and distribution of media may be outsourced to third-party providers, including but not limited to:
    • HDPhotoHub
    • Zillow
    • Dropbox
    • Other real estate media platforms
  • Panorama Home Photography is not responsible for delays, errors, or service interruptions caused by third-party providers.

8. Limitation of Liability

  • Panorama Home Photography is not liable for any issues related to the condition of the property.
  • We are not responsible for any inaccuracies in marketing materials created using our media.
  • If a property is deemed unsafe, the photographer may cancel the shoot, and the client will receive a full refund.

9. Dispute Resolution & Governing Law

  • All disputes must first be handled through mediation.
  • These Terms and Conditions are governed by the laws of the State of Colorado.

10. Changes to Terms and Conditions

We reserve the right to update these Terms and Conditions at any time. The most recent version will always be available on our website:
